By accessing or using the Site, creating an account, placing an order, or purchasing products or services from Mountain Mycology, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site.
You must be 21 years of age or older to access the Site, create an account, place an order, or accept delivery.
We require valid government-issued photo identification at delivery. We may refuse service if:
ID is not provided,
ID appears invalid, altered, or does not match the recipient, or
the recipient is not at least 21.
You may check out as a guest or create an account through Shopify. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
We may offer products and services that include mycology cultivation supplies and related items (“Products”). Product descriptions, images, and pricing may change without notice. We make reasonable efforts to display accurate information but do not guarantee that descriptions, pricing, or availability are error-free.
If we discover an error (including pricing), we may cancel or refuse an order and will contact you if needed.
Submitting an order is an offer to purchase. We may accept, decline, or cancel orders in our discretion, including for availability, suspected fraud, or delivery constraints.
After an order is placed, a Mountain Mycology representative will contact you to schedule delivery. You may also place orders by phone at 313-380-0171.
We currently accept cash only.
Drivers do not carry change.
Tips are appreciated but not required.
Minimum order: $35.
Delivery fee: $15 flat fee on orders under $100; waived on orders $100+.
We offer local delivery only and do not ship products.
Service area is limited to the following locations (the “Service Area”): Detroit, Ann Arbor, Hazel Park, Ferndale, and Jackson, Michigan.
Delivery details, cutoffs, scheduling, ID requirements, and safe-hand-off rules are described in our Delivery Policy, which is incorporated into these Terms by reference.
You may cancel an order:
within 30 minutes of placing it by calling 313-380-0171, or
when our representative contacts you to schedule delivery (before dispatch).
Once an order is dispatched, cancellation may not be possible.
Our Returns & Refunds Policy is incorporated into these Terms by reference. In summary:
Unused cultivation supplies may be eligible for return within 5 days (conditions apply).
Most other items are final sale, except limited circumstances described in the policy (e.g., verified issues within the stated timeframe).
To protect our drivers and customers, you agree to the following:
Provide a safe, well-lit delivery location (public meet-up is allowed).
No harassment, threats, or unsafe conduct.
No requests for drivers to enter homes, pass through unsafe areas, or complete delivery in unsafe conditions.
We may refuse or discontinue service if a delivery location or interaction is unsafe, unlawful, or inconsistent with our policies.
You agree not to:
use the Site for unlawful activity,
attempt to interfere with Site functionality,
submit false or misleading information,
impersonate others or use stolen payment/identity information,
resell Products unless separately authorized by us in writing (wholesale/vendor terms are separate).
No medical advice. Content on the Site is for informational purposes only and is not medical, legal, or professional advice. You should consult qualified professionals for advice tailored to you.
No warranties. To the maximum extent permitted by law, the Site and Products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Mountain Mycology will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data. Our total liability for any claim relating to the Site, Products, or these Terms will not exceed the amount you paid to Mountain Mycology for the order giving rise to the claim.
Some jurisdictions do not allow certain limitations; in that case, these limitations apply to the fullest extent permitted.
You agree to defend, indemnify, and hold harmless Mountain Mycology and its owners, employees, contractors, and agents from claims arising out of your breach of these Terms, your misuse of the Site, or your violation of applicable laws.
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any disputes will be brought in state or federal courts located in Michigan, unless otherwise required by law.
We may update these Terms from time to time. The “Effective Date” will reflect the latest version. Continued use of the Site after changes means you accept the updated Terms.
